Introduction

Infotriever, Inc. (“Infotriever”) provides software and services to enable individual (“Users”) to automatically receive and remain updated on event, contact, and other information (the “Service”). Infotriever is committed to protecting the privacy of this information and, in particular, any information that can be used to identify Users (“Personal Information”).

The statement below outlines Infotriever’s Privacy Policy. Infotriever may update its Privacy Policy to reflect changes in the services that Infotriever offers, however, the underlying goal of protecting User privacy remains the same. By using the Service, clients and Users agree to accept this Privacy Policy, are aware that Infotriever’s Privacy Policy may change from time to time and that your continued use of the Service will represent your willingness to be bound by this Privacy Policy, as modified. You are advised to review this page regularly for any changes.

Infotriever is a licensee of the TRUSTe Privacy Program. TRUSTe is an independent organization whose mission is to enable individuals and organizations to establish trusting relationships based on respect for personal identity and information by promoting the use of fair information practices. This privacy statement covers the site www.infotriever.com, my.infotriever.com and associated services, however please note that the TRUSTe Privacy Program does not certify software downloads. As a demonstration of our commitment to Users’ privacy, we have agreed to disclose our information practices and have our privacy practices reviewed for compliance by TRUSTe.

TRUSTe will serve as a liaison with Infotriever to resolve User concerns.

Information Collection

Infotriever is the sole owner and user of the information collected on the Infotriever corporate website (www.infotriever.com) and the my.Infotriever portal (my.infotriever.com).

Anonymous Infotriever Users

In some cases, Users may use the Infotriever service without providing any personal information to Infotriever. In these cases, the Infotriever desktop software may be used anonymously and is assigned an identification number only for the purpose of providing updates or opt-in automatic information deliveries relevant to the user’s information subscriptions.

Infotriever Account Holders

Users may install the Infotriever service and in some cases, uses the basic Infotriever service, without creating an account or providing any personal information to Infotriever. In these cases, the Infotriever desktop software may be used anonymously and is assigned a unique, non-personal, identification number for the purpose of delivering or updating information to the User.

Infotriever Users have the option of creating an Infotriever Account in order to sign up for the delivery of premium content, or to obtain access to advanced features and services not available to anonymous Users of the basic Infotriever service. In these cases, Users are required to enter a first name, last name, valid email address (used as a username) and a password in order to establish an account. The User’s first name and last name are used to provide a more personalized experience on the User’s personal my.Infotriever portal and in service emails. The email address and password are required as login credentials and are used to reactivate the Infotriever account after reinstalling, or identify the recipient of premium content services. This information is stored on the Infotriever server, but is not sold or shared with 3rd parties.

Infotriever LiveContact™ Holders

Infotriever account holders have the option of creating a LiveContact that can be added to their email signature. The LiveContact acts as a personal electronic business card by allowing you to easily share your personal contact information with friends and business associates. When you create a LiveContact, you acknowledge that you are willing to share the Personal Information you provide for the LiveContact link with individuals to whom you provide the link. You further acknowledge that others may receive the link through forwarding or by typing the link into a browser. When creating your LiveContact, you may choose to provide us with as little or as much Personal Information as you wish to share with those who receive your link directly or indirectly. This Personal Information is stored on the Infotriever server, but is not sold or shared with 3rd parties.

Users of the Infotriever Corporate Website

Users of the Infotriever corporate web site have the option to request sales information on specific products and services, and in so doing are required to provide a limited amount of personal contact information. This information enables Infotriever representatives to contact that individual for the purpose of providing information on the products or services requested. This personal information is not sold or shared with 3rd parties.

Purchasing

In some cases (e.g. for premium content services), Users have the option to purchase access to the Service online. In doing so, the customer is requested to provide contact information (such as name email address and phone number) and financial information (such as credit card number, expiration date). This information is used for billing purposes and to fill customers’ orders. If Infotriever has trouble processing an order, this information is used to contact the customer. Infotriever uses a reputable third party transaction processor to fulfill online order processing from the Infotriever web site. Infotriever transmits the credit card information solely for the purpose of completing the transaction, and does not retain the credit card information on an ongoing basis.

Information Use

Apart from Users’ personally identifiable information stored on the Infotriever servers, Infotriever stores other non-personally identifiable information using cookies and log files.

Cookies

A cookie is a piece of data stored on the User’s computer tied to information about the User. Infotriever uses both session ID cookies and persistent cookies, as outlined below. A persistent cookie is a small text file stored on the User’s hard drive for an extended period of time. Session ID cookies simply terminate when the User closes the browser. Persistent cookies or the usage of cookies can be removed by following your Internet browser’s help file directions.

The my.Infotriever portal uses a persistent cookie only for automatic login purposes and is set when the User explicitly opts-in for the “remember me” check box on the Users’ login for their portal. Users that don’t accept this option will be prompted to provide login credentials each time they access their my.Infotriever portal. Infotriever may also use persistent cookies to store certain preferences about the User’s use of the Service. For example, cookies may be used to allow a User to set a preference to skip a verification screen when capturing information.

Persistent cookies are also used in some circumstances to track the click-through and click stream of visitors on the Infotriever corporate website. This click-through and click stream information is stored anonymously, and is only associated with an individual if they enter their information on the Infotriever corporate website.

If you reject cookies, you may still use our site, but your ability to use some areas of our site, such as contests or surveys, will be limited. This privacy statement covers the use of cookies by Infotriever only and does not cover the use of cookies by any advertisers or third parties.

Aggregate Information

Infotriever may use Users’ Personal Information to generate aggregated information that does not allow the User to be personally identified or contacted. Aggregated Information shows User activity as a whole rather than on an individual basis and may be used by Infotriever to provide insight on the usage of the Service.

Log Files

Like most standard Web site servers, Infotriever uses log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track User’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information through the Infotriever services.

Infotriever Software Log Files

The Infotriever software records User activity to log files that are stored on the User’s computer at the following location: “C:\Program Files\Infotriever\Agent\data\[username]“. These log files are used to provide User controls to manage the information the Users have captured using Infotriever, and are also very useful in the event that you request Infotriever technical support. Neither Infotriever nor any other party has access to this log file.

Infotriever Usage Log

Infotriever collects certain information (which may include Personal Information) when the User uses the Service. For example, if Users use the Service to capture their travel itineraries in their personal organizers, information about the booking will be sent to Infotriever’s servers, which in turn will deliver the requested information through the Infotriever software on the Users’ computers into their personal information managers (PIM). Infotriever tracks the information captured in order to provide Users with updates to the information, if necessary.

Companies that enable their business with Infotriever may provide Users with the option of having information automatically added to their PIM without further confirmation from the User. For example, a client may allow Users to have their travel itinerary inserted into their personal organizer automatically when the Users make reservations.

Note that Infotriever does not require that Users upload or synchronize the Personal Information contained in their PIM in any location other than their PIM.

Client Information

In order for clients to use Infotriever’s technology to deliver and insert information into Users’ PIMs, Infotriever requires that certain Personal Information relating to the information the User captured through Infotriever on the client site be collected and stored on Infotriever’s servers. This information may include a username, email address and other data specific to the application, e.g. flight information for travel itineraries. Infotriever does not disclose any of its client’s information to other Infotriever clients or potential clients. Information is securely stored on Infotriever’s servers and accessible only by employees of Infotriever for general reporting and billing purposes. Infotriever will not disclose Personal Information to any organization without the User’s consent, except to provide the Infotriever service to Users where the information is required for and used only for such purpose.

Communications from the Site

Updates & Notifications

The email address of account holders is used for confirmation of a successful account creation, signup for premium services, LiveContact setup, acceptance notifications for the ExecAssist feature, or for general service announcements. In addition, Infotriever sends periodic newsletters to individuals who have opted in to receiving them, either during account creation, by subscribing at the Infotriever website or from emails forwarded by other opted in recipients, or in direct conversations or correspondence with Infotriever representatives. Recipients may unsubscribe from the newsletter at any time by using the provided unsubscribe link within the email or by emailing privacy@infotriever.com.

Service Announcements

We may, from time to time, send out strictly service-related announcements. These communications are not promotional in nature. For instance, we may send out confirmation of the creation of an account, signup for a service, or notification of upcoming maintenance windows that may require a short temporary suspension of the Service. Users may not opt-out of these communications, though they may always deactivate their account and discontinue using the Service.

Customer Service

We communicate with Users on a regular basis to provide requested services and assist them with technical support.

Information Sharing

These are the instances in which we will share or publish information:

Reporting – Aggregate Information

Infotriever may generate aggregated information relating to activity on Infotriever-enabled businesses. This aggregate information does not allow the User to be personally identified or contacted and shows User activity as a whole rather than on an individual basis. This information may be shared with relevant Infotriever customers from time to time for billing and usage purposes. For example, Infotriever may inform clients of the total number of Infotriever Users who have captured a certain kind of information.

Reporting – Unique User Information

In some circumstances, a company using Infotriever to communicate information to Users may provide Infotriever a unique identifier for the User and request that Infotriever report whether a download using the Infotriever service has occurred for each such unique identifier. Infotriever only indicates whether each unique identifier has used the Service for the purpose of results measurement of the Service, and does not share any personally identifiable information provided by the User to Infotriever. Infotriever transmits this information at the company’s request, and this information is not shared with the company or any other third party for any other purpose.

Third Parties

Infotriever uses third parties for transaction processing, website content management, and email management. In all cases, Infotriever ensures that these third-party service providers maintain the privacy of your information in accordance with this privacy policy.

Nominate a Service – Personal Information

The Infotriever website provides the ability for Users to nominate a website that they would like to see using Infotriever. At the time of nomination, Users are asked to provide their name and email address. Infotriever may provide the nominated organization with the Users name and email address in a situation where they wish to contact nominating individual.

Business Transition – All Information

In the event Infotriever goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, User’s personal information will, in most instances, be a part of the assets transferred. If, as a result of the business transition, Users’ information will be used or shared in a manner different from that stated at the time of collection, they will be given choice consistent with our notification of changes section.

Links

The Infotriever web sites may contain links to other sites. Please be aware that this privacy statement applies solely to information collected by the Infotriever service and website, and that Infotriever is not responsible for the privacy practices of such other sites. We encourage our Users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information.

Surveys

Occasionally, we survey our Users to provide us more insight into the nature of their usage, to obtain a demographic profile of our Users, or to request feedback on existing or future features and services. Participation in these surveys is completely voluntary, and the User therefore has a choice whether or not to disclose this information. User’s personally identifiable information is not shared with third parties unless we give prior notice and choice. Though we may use a third party to conduct these surveys or contests, they may not use User’s personally identifiable information for any secondary purposes.

Tell-A-Friend

Users may elect to use a “Tell a Friend” referral for informing another person about our service. In such cases, the User may be requested to provide the name and email address of the individuals to whom they wish to refer the Service. Infotriever will automatically send the referred parties a one-time email at the User’s request, and will store this information for the sole purpose of sending this one-time email, and tracking the success of our referral program. Any individual whose email address has been stored for such purpose may contact Infotriever at privacy@infotriever.com to request the removal of this information from our database, and the User may also re-send another one-time email, or delete the referred party from the tracking list.

Testimonials

When you submit a testimonial for use on the Infotriever website or marketing materials, we request that you provide your name, title and company for publication with the testimonial. If your testimonial is used, please be aware that your personally identifiable information may be read, collected, or used by other visitors to the Infotriever website or viewers of the Infotriever marketing materials. Infotriever is not responsible for the personally identifiable information you choose to submit.

Legal Requirements

Other than as set out above, Infotriever will otherwise only release Personal Information to third parties in the following limited circumstances: (i) if a law, regulation, search warrant, subpoena or court order legally requires Infotriever to do so; (ii) if Infotriever’s rights or property or the rights or property of Infotriever’s affiliates, subsidiaries, service providers or the Users of Infotriever’s web site or services are in jeopardy; or (iii) if the personal safety of Users of Infotriever’s web site or services or other members of the public is in jeopardy.

Security

Infotriever employs advanced security measures in order to prevent the loss, misuse, and alteration of Personal Information under Infotriever’s control. However, no transmission over the Internet can be guaranteed to be completely secure. Consequently, Infotriever, its affiliates, subsidiaries, service providers and their respective officers, directors, employees and agents do not represent, warrant or guarantee that Personal Information will be protected against misuse, loss or alterations and do not accept any liability for Personal Information submitted to or collected by them nor for your or third parties’ use or misuse of Personal Information. Correcting/Updating/Deleting/Deactivating Personal Information

If an account holder’s personally identifiable information changes (such as zip code, phone, email or postal address), or if a User no longer wishes to use the Service, you may correct, update or delete/deactivate your personally identifiable information through your homepage, or by emailing service@infotriever.com. Account holders will receive a response to requests within 10 business days.

Notification of Changes

If we make changes to our privacy policy, we will post those changes to this privacy statement on the Infotriever corporate web site and such other places as we may deem appropriate so our Users are always aware of what information we collect, how we use it, and under what circumstances, if any, we may disclose it. We will use information in accordance with the privacy policy under which the information was collected. In the event that there are material changes to this privacy policy, we will post an appropriate notification of the changes at the top of the Infotriever privacy policy web page for a period of 30 days, and will notify registered users by an email Service Announcement.

If, however, we are going to use User’s personally identifiable information in a manner different from that stated at the time of collection we will notify Users via email. Users will have a choice as to whether or not we use their information in this different manner. However, if Users have opted out of all communication with the site, or deleted/deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner.
